Adultery is a special ground for divorce in Turkish law, with conditions and deadlines distinct from the general grounds.
Time limits
6 months from the spouse's knowledge of the act, and at most 5 years from the act itself. Missing this bars reliance on adultery (but breakdown remains available).
Evidence
Messages, witnesses, photos, admissions (an admission alone is not enough). Private-investigator reports are admissible if the privacy of homes is not breached.
Forgiveness defeats the claim
If the spouse continues married life after learning of the adultery (implied forgiveness), the right to invoke adultery is lost.
Moral damages
Typically higher than other divorce grounds — because of personal and social humiliation. The at-fault spouse normally pays.
Inheritance
The adulterer does not automatically lose inheritance rights, but disinheritance can be sought in specific cases.
