Uncontested divorce — faster, less attritional

Where spouses agree on divorce, division of assets, custody and support, an uncontested divorce is generally finalised in a single hearing. The decisive step is drafting a protocol that genuinely protects both parties.

A well-drafted uncontested-divorce protocol pre-empts most later disputes about custody, visitation and support adjustments. We walk clients through every clause, run worst-case scenarios, and share the document in writing before signing.

Contested divorce and asset division

Where parties disagree, the divorce becomes a multi-layered process covering fault, compensation and "poverty" alimony. Witnesses, social-media records, banking history and medical reports must be assembled methodically.

Under the participation-in-acquired-property regime, assets acquired during the marriage are split equally as a rule. But inheritance, gifts, personal property exceptions, banking flows and company shares require special expertise. The matrimonial-property liquidation case can run separately after the divorce becomes final.

Custody, visitation and support

Custody is decided on the child's best interest. The court weighs the parents' environments, the child's age and education, and the child's own statement (where age permits) among many factors.

Different forms of support (interim, child, "poverty", and assistance support) apply in different conditions. Where economic conditions change over the years, support amounts can be adjusted up or down through a separate proceeding.

Domestic violence and protection orders (Law 6284)

Persons subjected to or under threat of violence may seek a protection order under Law 6284. Such orders are typically issued the same day and may include restraining orders, contact bans, interim custody and support.
