A child born during marriage is presumed the husband's. The presumption can be rebutted by lawsuit.
Time limit
One year from the husband's knowledge of grounds for suspicion, and at most five years from the child's birth. Delay forfeits the right.
Primary proof: DNA
Genetic testing is decisive. The court orders it at a forensic lab. Refusal to test can be interpreted against the refuser.
Supporting evidence
Husband's absence during conception (travel, prison), inability to procreate (medical report), the mother's correspondence, witnesses.
Effect of judgment
The child loses the family name and inheritance rights from the husband. Custody passes to the mother or to the biological father, who is registered if possible.
Effect on marriage
Often a ground for divorce by adultery. Moral damages are typically high.
