Construction contracts are complex civil agreements. Disputes are common, but the owner has strong rights.
Late delivery
If delay exceeds the agreed period (usually 6–12 months): rescission, damages, return of payments.
Incomplete or defective work
The developer must complete the work to specification. Any deficiency justifies repair or price reduction.
Non-conforming flat
If a flat materially different from agreement is offered (size, floor, orientation), the owner can refuse, or accept with compensation.
Evidence
The original contract, receipts, photos of work, correspondence, expert reports. Time-stamped video and photos help greatly.
Remedies
Notarial demand, mandatory mediation, suit for rescission with damages, suit for specific performance (forcing completion).
Mandatory insurance
Developers must insure the project. On developer failure, the owner can claim from the insurer directly.
