Damages are a protected right, but valuation requires precision in proof and judicial discretion.
Material damages
Actual loss: medical bills, income loss, repair costs. Plus lost profit: what would have been earned. Each item requires receipts or expert evidence.
Moral damages
Pain and suffering, loss of a relative, permanent impairment, reputational harm. The judge assesses freely, considering severity, social context and the wrongdoer's means.
Typical figures
10,000–500,000 TL moral, depending on the case. Death: 50,000–300,000 per first-degree relative. Permanent injury: by disability percentage.
Statutory interest
Runs from the date of the harmful act, or from formal demand. Accrues until actual payment.
Reduction for contributory fault
If the victim shares fault (provocation, encouragement), damages are reduced proportionally. Total fault eliminates the right.
