An indefinite-term contract does not end abruptly. Both sides owe advance notice. Skipping the notice triggers compensation.

Statutory periods

Less than 6 months: 2 weeks. 6 months–1.5 years: 4 weeks. 1.5–3 years: 6 weeks. Over 3 years: 8 weeks.

Who pays

The employer if dismissing without notice. The employee if resigning without notice (deducted from severance or claimed separately).

Calculation

Gross daily wage × days of notice. Gross includes fixed allowances and recurring bonuses.

When notice pay is not owed

Just-cause dismissal under Article 25/II of the Labour Code (gross negligence, fraud, repeated absenteeism) does not require notice or notice pay.

Pay-in-lieu of notice

If the employer wants to end the contract immediately, paying the notice-period wages in full is lawful and dispenses with the actual notice.
