Co-ownership can become a source of conflict. The law gives every co-owner the right to demand partition.

Physical division

If physically possible (large divisible land), the court orders division. Each co-owner receives an independent piece equal to their share.

Forced sale

If physical division is impossible (a flat, a house, a small parcel), the court orders public auction. Proceeds are distributed by share.

Auction

Held publicly. Co-owners may bid. The highest bidder becomes sole owner.

Duration

Typically 1–2 years given the need for expert reports and notice periods.

Costs

Expert fees, court fees, publication costs are deducted from the sale before distribution.

Voluntary alternative

Often a voluntary buyout (one co-owner buying out the others) is faster and cheaper.
