The reinstatement suit is one of the strongest tools the Turkish employee has. But the deadline is short and absolute.
Conditions
1) 30+ employees, 2) 6 months of service, 3) Indefinite-term or fixed-term contract (definite-term project contracts excluded), 4) Dismissal without just cause or without proper procedure.
The 1-month deadline
A lawsuit must be filed within 1 month of the dismissal date. No extension is possible.
Burden of proof
The employer must prove just cause. This is a stronger position for the employee than other cases.
Possible outcomes
Win: 1) Reinstatement, or 2) If the employer refuses to reinstate (common): 4–8 months' wages as reinstatement compensation + 4 months' wages for the no-work period + all other entitlements.
