51% of apartment owners decide. But the rest still have rights: a fair valuation and the choice between in-kind (a flat in the new building) or cash compensation.
Valuation
By certified experts. A second valuation can be requested in dispute. Price must reflect market value, not book value.
Substitute right
If the owner picks in-kind, an equal-area or close flat is provided. Differences are settled in cash.
Protection from coercion
An owner cannot be removed by force before valuation and offers. Any such attempt fails in court.
Objection lawsuit
For low valuations or denied in-kind: lawsuit at the general civil court. Deadline: 30 days from the municipality's decision.
Temporary housing
The owner is entitled to a rental allowance during construction, or a comparable temporary unit.
